What is Chapter 7 Bankruptcy?

Chapter 7 bankruptcy, or liquidation bankruptcy, is designed for individuals in financial difficulty who do not have the ability to pay their existing debts. Under the Chapter 7 bankruptcy plan, a bankruptcy trustee liquidates your assets to pay creditors (although many assets are exempt from the program), allowing you to retain possession of items such as your home or primary vehicle.

The purpose of Chapter 7 bankruptcy is to obtain a discharge of your existing debts, relieving you of your obligation to repay certain creditors. However, some debt, including tax arrears, student loans, alimony and support, criminal restitution and debts for death or personal injury caused by driving while intoxicated are not dischargeable.
